The Ted Cruz Contest that shoot who would want to win

For one to see authoritarian decrees and a forced relinquishing of several Constitutional rights one need not look at any legislation, laws, Executive Orders, or Memoranda; one only needs to review the official rules for the “Shoot with Cruz” sweepstakes.

Consider that:

The winner will pay taxes on an undetermined amount and supply the Cruz campaign with the IRS Form W-2G and 5754 at least 60 days before awarded the prize.

The prize is:

“A shooting excursion with Ted Cruz. The shooting excursion will occur at a specific time and place to be determined by Sponsor. The duration of the excursion will be at the sole discretion of the Sponsor. If winner is unable to attend the shooting excursion at the time and place determined by Sponsor, the prize will be forfeited.”

The lucky winner is:

“responsible for securing all required licenses and for costs of transportation to attend the shooting excursion (including, but not limited to ground transportation, airfare, personal charges at lodging, telecommunications charges, security fees, taxes, or other expenses or incidentals.”

Of course:

this ain’t for no 2nd Amendment hating person like those who argue that background checks will not stop gun violence, but those checks may help save a life by at worst giving someone a few moments to consider the responsibility in purchasing and using a tool with such power as a firearm.

Oops that ain’t the case with Senator Cruz here because:

“Sponsor may, at its option, conduct a background check on each potential winner. Sponsor reserves the right to disqualify any potential winner from receiving the Prize based on such background check if Sponsor determines, in its sole discretion that awarding the Prize to such potential winner could result in a safety or security risk to any person or persons or could result in the disruption of any event associated with the Promotion.”

  • So it’s not a Constitutional issue because Senator Cruz all by himself has the power to determine whether or not an individual is allowed to carry a firearm in his presence even within a state that just expanded open carry rights.

And if you win:

“entry into the Promotion constitutes permission to use each winner’s name, hometown, likeness and/or prize information, without limitation, for promotional purposes without further permission or compensation.”

  • So apparently your name, likeness, and so on may one day be on billboards advertising for businesses, churches, or perhaps even an enterprise such as an abortion clinic that Senator Cruz may have interests.

Ah but there is still a potential pitfall:

“As a condition of being awarded the Prize, the winner may be required to execute and deliver to Sponsor a signed affidavit of eligibility and acceptance of these Official Rules and release of liability, and any other legal, regulatory, or tax-related documents required by Sponsor in its sole discretion within five (5) business days of notification.”

  • Does one only have five (5) business days of notification and at the Sponsor or Senator Cruz’s sole discretion?
  • I thought the winner had 60 days prior to delivery of the prize to give the Senator copies of the tax forms?
  • Is it 5 or 60?  Will I be telephoned or emailed?
  • When and where to we hunt?
  • As the lucky winner I paid how much to partake in possibly 30 seconds of hunting?
  • Even though not required to win, I paid everything along with my $2,700 donation?

“Odds of winning the Prize depend on the number and quality of eligible entries received. ALL FEDERAL, STATE AND LOCAL TAXES ASSOCIATED WITH THE RECEIPT OR USE OF ANY PRIZE ARE THE SOLE RESPONSIBILITY OF THE WINNER. THE PAYMENT OF THE REGULAR GAMBLING WITHHOLDING AND COMPLETED IRS FORM W-2G AND 5754 SHALL BE PROVIDED TO SPONSOR WITHIN 60 DAYS FOLLOWING THE DRAWING AND PRIOR TO DELIVERY OF THE PRIZE. The Prize may be forfeited and awarded to an alternative winner if the winner affidavit and release materials (see Sections 10 and 11 below) are not returned as required from the winner or if two (2) attempts to contact the winner in person, by phone, and/or e-mail (at Sponsor’s own discretion) within 60 days following the drawing are not successful, or if the Prize is otherwise not claimed.”

Shoot I reckon this shoot may be a work and even though shooting makes me think about hunting this might actually be fishing because something smells like a dead gator gar, and I’ll betcha that the winner {wink, wink} ain’t gonna be selected at random.

Caveat Emptor, but who is buying?   If you’re a participant you just might be a gambler trying to gain entry into a shoot, free from any suppression of rights or liberties.  YEP!!!!!!!!
